Terms of Service

1. About these terms

These terms are an agreement between you and TalkTable (operator details will be added before launch): [LEGAL NAME], [REGISTERED ADDRESS], company number [CRO NUMBER] (“TalkTable”, “we”, “us”).

Sections 2–12 apply to restaurants and their team members using TalkTable as a business service. Section 13 applies to diners using a restaurant's table page. Section 5 (allergens and AI) applies to everyone. Our Privacy Policy explains how we handle personal data.

2. The service

TalkTable lets a restaurant publish a digital menu reached by table QR codes, receive orders and service requests on a staff dashboard, and offer an AI assistant that answers diners' questions, builds orders from chat or voice, translates the menu and helps restaurant admins manage their menu.

No payments are processed by TalkTable. Diners pay the restaurant directly, using whatever methods the restaurant accepts. Prices shown are set by the restaurant.

3. Restaurant accounts

  • You must be at least 18 and authorised to bind the restaurant business you register.
  • The person who registers is the account owner and is responsible for everyone they invite (staff and admins) and everything done under the account.
  • Keep passwords confidential and tell us promptly at the contact below if you suspect misuse.
  • Give accurate information and keep it up to date.

4. Your responsibilities as a restaurant

You are responsible for:

  • The accuracy of your menu — names, descriptions, prices, availability, dietary tags and allergen information, including anything the AI extracted from a menu photo or translated. Review AI-generated content before you publish it.
  • Meeting your food-information obligations, including EU Regulation 1169/2011 on food information to consumers and the guidance of the Food Safety Authority of Ireland (FSAI) on allergen information for non-prepacked food. TalkTable is a tool to display information; it does not replace your legal duty to provide allergen information on request and through your staff.
  • Training your staff to handle orders, allergen questions and service requests.
  • Your relationship with diners: you are the seller of the food and drink, you set prices, and you deal with complaints, refunds and payment.
  • Your obligations as data controller for diner data processed through your table pages, including telling diners how you use it (you may link to our Privacy Policy).
  • Content you upload (menu photos, images, banners) — you must have the right to use it.

5. Allergens and AI — important

AI answers about dishes, ingredients and allergens are for information only and may be wrong or incomplete. If you have a food allergy or intolerance, always confirm with the restaurant's staff before ordering. Do not rely on the AI assistant or the digital menu alone.

  • The AI assistant is designed to answer only from the restaurant's menu data, but AI systems can make mistakes, misread menu photos or translate imprecisely.
  • The restaurant — not TalkTable — is responsible for the accuracy of allergen and ingredient information and for the food it serves.
  • Allergy information a diner records in their profile is used to guide suggestions; it is not automatically passed to the kitchen. Tell staff about allergies, and add a note to your order.

6. Acceptable use

You must not, and must not let anyone else:

  • use TalkTable for anything unlawful, misleading or harmful, or to sell prohibited goods;
  • upload content that infringes others' rights or contains malware;
  • try to access other restaurants' data, probe or overload the service, bypass plan limits or security controls, or scrape the service;
  • misuse the AI features — for example to generate content unrelated to running your restaurant, or in breach of our AI provider's usage policies;
  • resell or white-label the service without our written agreement.

7. Plans, trials, limits and fees

  • New restaurants start with a 14-day trial of the Pro plan. After the trial, features depend on the plan you choose.
  • Each plan includes a set of features and limits — for example the number of tables and menu items and a monthly allowance of AI messages. When a limit is reached, the related feature may pause until the next period or an upgrade.
  • We may apply fair-use caps on AI usage (chat, voice, translation, menu-photo reading) to protect the service and control costs, and will tell you if your usage is unusually high.
  • Fees, billing and payment terms: [TO CONFIRM — pricing and billing not yet live]. We will give at least 30 days' notice of price changes.

8. Your data and our processing

You keep ownership of your menu, content and restaurant data. You give us a licence to host, process and display it as needed to run the service. We may use aggregated, de-identified statistics to improve TalkTable.

For diner personal data processed on your behalf, we act as your processor under our data processing agreement [DPA TO BE PUBLISHED], which forms part of these terms.

9. Availability and changes

The service is provided “as is” and “as available”. We aim for high availability but do not guarantee uninterrupted or error-free service, and we may carry out maintenance. We may change or remove features; if a change materially reduces what a paying customer receives, we will give reasonable notice. Keep your own backup of key information (such as your printed menu and allergen records) so you can serve customers if TalkTable is unavailable.

10. Liability

  • Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
  • To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, revenue, goodwill or data.
  • We are not responsible for the accuracy of menu or allergen information supplied or approved by a restaurant, or for food and service provided by a restaurant.
  • Our total liability to a restaurant in any 12-month period is limited to the fees it paid us in that period, or [TO CONFIRM — e.g. €100] if greater.

11. Suspension and termination

  • You can stop using TalkTable at any time and ask us to close your account by emailing us.
  • We may suspend or close an account that breaches these terms, puts the service or others at risk, or where required by law, with notice where reasonable.
  • After closure you can ask for an export of your menu and order data within [TO CONFIRM — e.g. 30 days]; we then delete it as described in our Privacy Policy.

12. Governing law

These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction. If you are a consumer, you keep the protection of mandatory laws of the country where you live and may bring proceedings there.

13. For diners

If you use a restaurant's TalkTable table page:

  • The restaurant is the seller. Your order is a contract with the restaurant, which sets prices, prepares your food, takes payment and handles complaints and refunds. TalkTable only provides the ordering software.
  • An order is sent to the restaurant only when you confirm it. The AI assistant can suggest items and fill your cart, but check your cart before you confirm.
  • AI answers may be wrong. For allergies and intolerances, always confirm with staff (see section 5).
  • Use the page only for genuine orders and requests at the table you are seated at.
  • A diner account is optional and free. You can delete it at any time from your account page.

14. Changes to these terms

We may update these terms. We will post the new version here with a new “Last updated” date and, for material changes, notify restaurant account holders by email at least 30 days in advance. Continuing to use TalkTable after changes take effect means you accept them.
